Divorce
Either spouse can seek a divorce. To succeed, they need to establish that:
"the marriage is broken down irretrievably."
The only evidence of this is that the parties have been separated for more than twelve (12) months. "A separation" under the one roof is possible within the twelve month period. It is not necessary for the marriage to have occurred within Australia. The matter must be resolved within 12 months of the divorce becoming absolute.
